Brexit Residency Card Renewal in France: How LBS Helps You Stay Legal

Here at LBS, preparations for the Brexit residency card renewals have been underway for several months. The team anticipated this development and is prepared to address any complexities that may arise with the process.

Over the past six months, the LBS team has been reaching out to prefectures throughout France to gather information on their intended procedures. While some prefectures have provided clear guidance, others have not yet finalised their plans. The team continues to follow up with these prefectures to help ensure the process moves forward within the required timeframe.

Here’s what you need to know to keep your paperwork in order and your residency secure.

Implications for British Citizens

British citizens residing in France, as well as their family members, who established residence prior to January 1st, 2021, were granted residency rights pursuant to the Brexit Withdrawal Agreement. Depending on individual circumstances at that time, individuals were issued either a five-year or ten-year residency permit.

Renewal Process for Five-Year Residency Cards

Holders of five-year residency cards will begin to expire in 2026. Upon expiration, they will be replaced by a ten-year residency card:

 ‘Séjour permanent – Article 50 TUE/Article 18(1) Accord de retrait du Royaume-Uni de l’UE’.

The renewal period will commence three to four months prior to the expiry date indicated on your current card. Please review your card details carefully and make necessary arrangements in advance to ensure a seamless transition.

What if you have a Ten-Year card?
If you hold a 10-year card, don’t worry—you’re good to go until its expiry. When that time comes, it will be replaced with a permanent residency card.

What is the renewal process?

The renewal procedures vary by prefecture:

  • Some require a traditional paper application.
  • Others mandate that applicants schedule an appointment.
  • Certain prefectures now accept online submissions.

What Documents Will You Need?

Similar to when you applied for your first card, you’ll need to gather some essential paperwork. These include:

  • Proof of ID & Valid Residency Card
  • Passport
  • Contract of Engagement
  • Proof of 5 years’ residence in France for 5 Years (such as tax documents, work contracts, rental agreements, utility bills, etc.)

Once you submit your application, the prefecture will either invite you for a final appointment or simply post your new card to you—depending on their process (and how modern they are feeling!).

Key Considerations Prior to Your Renewal

This is an ideal time to ensure all your documentation is prepared for the renewal process. Common issues that may delay or impact your application include:

  • Undeclared name changes or changes in marital status
  • Failure to update your address on your card
  • Residency cards requested but not collected (including duplicates issued due to loss, theft, or address change)
  • Pre-Brexit EU residency cards that were not exchanged for an Article 50 card

Reviewing these aspects ahead of time can help prevent unnecessary delays in your renewal.

What About British Children turning 18?
If your British child is about to turn 18, they can apply for their own residency card between their 18th and 19th birthdays.  In the meantime, you can request a Document de circulation pour Etranger Mineur (DCEM) to enable them to travel freely with you.
